In the U.S. Court of Appeals for the Fourth Circuit, attorneys Benjamin Fink and Jeremy Kahn represented the appellees, two former employees of a nationwide, billion-dollar staffing company.
The appellate court affirmed summary judgment for both of BFV’s clients, holding that they had not breached their fiduciary duties or violated their customer non-solicitation, confidentiality, or return of information covenants with their former employer.
In the U.S. Court of Appeals for the Fifth Circuit, attorneys Benjamin Fink, Lea Dearing, and Ashley Bowcott also secured an appellate victory. They had obtained summary judgment in the lower court on behalf of defendants in a complex noncompete and trade secret misappropriation matter. The appellate court affirmed, reinforcing the burden of plaintiffs to identify alleged trade secrets with specificity and highlighting the impact of challenging expert testimony.
