BFV wins appeal in restrictive covenants case. On February 18, 2009, the Georgia Court of Appeals affirmed a lower court ruling obtained by BFV that overly restrictive covenants in an employment agreement were unenforceable and not subject to arbitration. Click here for the opinion.

The Georgia legislature recently passed legislation significantly changing Georgia law on restrictive covenants, and the legislation was signed by the Governor on April 29, 2009. The law will not go into effect unless a referendum is passed by the electorate in the 2010 general election. During the legislature’s consideration of the new law, Benjamin Fink testified before a joint committee of the Georgia House and Senate which was studying the proposed legislation
